Terms & Conditions

All participants should read the following Terms and Conditions carefully. These constitute an “Agreement” between Globalink Internships Limited, an incorporated company in New Zealand (number 7170838) with a registered office at 8 Forbes St, Onehunga, Auckland 1061, New Zealand and the Participant.

“GI” “Us”, “We”, or “Our” refers to Globalink Internships Limited. “You” or “Your” also refers to Participant.

These Terms and Conditions apply to all participants in the Globalink Internship programme. By indicating in the space provided on the application form you acknowledge you have read and accept these terms and conditions.

1. Introduction

Globalink Internships Limited offers an internship programme in selected Asian destinations to provide participants with an opportunity to undertake a work experience placement. Our focus is on delivering a rewarding experience aligned to participants educational, personal and professional growth and aspirations and as such participants should be committed to undertaking a placement on this basis and have managed your expectations accordingly.

In entering the programme, you understand that the internship placements offered are unpaid (unless otherwise advised) and are for a period of three to six months (unless otherwise advised).

2. Eligibility of Participants

All participants must be aged 18 or above.

We retain the right to reject any application we deem unsuitable, at our sole discretion and at any stage of the process.

We do not discriminate on the basis of race, colour, religion, sex, sexual orientation, gender, national origin, citizenship, disability or any other legally protected right.

3. The Programme

GI undertakes to deliver the following services, after discussion and confirmation with individual participants who have signed onto the GI programme. These services are subject to the Terms and Conditions of this Agreement. GI reserves the right to make any reasonable changes to these services following prior consultation with you.

Services include:

We will secure an internship placement with a host company (or organization) in the destination you have selected and in accordance with your Acceptance letter.

This will include a job description and any Terms & Conditions including an agreement covering the internship position from the host company.

Globalink Internships undertakes to arrange rewarding and meaningful roles with substantial work requirements for participants however you accept that we have no control over the type or amount of work and the specific tasks that are assigned to you by the host company during your internship.

GI will engage with programme participants to provide background information on the destination, advice and suggestions on the internship experience  and information packs prior to departure.

GI will arrange a 30-minute introductory skype call between our in-market representatives in the appropriate location and participants. Contact details of our in-market representatives will be provided and participants will meet and engage with our in-market representatives upon arrival at the destination.

GI will arrange for participants to be met upon arrival at the airport (as per prior agreement on the location and other details) and be accompanied to your accommodation.

GI will also arrange for participants to be accompanied and transported to your host company on the first day of your placement.

GI will provide a welcome pack to all participants upon arrival at your destination (contents to be determined by us) which will also include a SIM card and where appropriate a “Public Transport” card with a small pre-loaded amount.

GI’s in-market representatives or their assigned staff will provide an orientation programme to participants during the first week of their arrival at the destination.

GI will provide furnished accommodation through a third party provider to participants from the start date of their internship to the end date of their internship. The cost of such accommodation is included in the overall programme fee.

GI will place participants in accommodation that is the same or similar to that advertised on our website and following confirmation from you.

If a deposit/bond is required by the accommodation provider, participants will pay this upon arrival. This deposit/bond will be refunded to you provided no outstanding bills including utilities are due and there is no damage to or theft of property.

Participants are responsible for paying all and any utilities as required and advised by the accommodation provider. Participants will be made aware of what utility payments are required prior to taking up the accommodation.

Participants have the option to pay the cost of accommodation direct to the accommodation provider – as per the terms and conditions stipulated by the provider or request GI or its representatives undertake this payment on your behalf.

If participants request GI or its representatives to pay on your behalf, participants must pay the full amount due for the contracted period covering accommodation in advance to GI and prior to arriving at the accommodation.

Under the above agreement, if participants leave the accommodation for any reason prior to the end of the contracted period, then you acknowledge that GI is not liable nor takes any responsibility to refund any remaining amount left covering the contracted period.

During your placement participants will be offered mentoring sessions by GI in-market representatives or appropriate third parties. These sessions will normally be for up to one hour each per month. Our in-market representatives will confirm timings, arrangements and details with participants upon arrival at your destination and following discussion with you.

Provision has been made for participants to undertake part time Chinese language training at 3-4 hours per week.

GI will provide guidance on obtaining visas and where necessary provide a sponsor letter from host organizations.

4. Acceptance Fee

Participants who wish to join the GI programme are required to complete an application form and provide any other information requested by us.

Once we have confirmed your suitability to enter into the programme you will be required to pay an acceptance fee of USD 300.

Upon receipt of this fee, GI will issue you with an acceptance letter which reserves your place on our programme, and we will then commence the process to identify an internship placement for you.

If you are applying for an advertised or promoted internship role by GI, you are first required to complete an application form and provide any additional information as requested by us. Once we have confirmed your suitability you will be required to pay an acceptance fee of USD 300 for us to proceed with your application. If you are unsuccessful in your application then GI will refund this fee or following discussion and agreement with you, retain it, and reserve your place on our programme in order to identify an alternative host company and internship role for you.

Participants who enter into the programme in response to an advertised internship role acknowledge that the host company offering the placement reserves the right to make the final decision regarding selection of the candidate.

All terms and conditions outlined in this document apply to participants who have been accepted into the programme – either in seeking internship roles through the application process or in response to specific internship roles advertised.

All participants agree that the information provided by you to allow us to make a decision to accept you into the programme is true and correct and should you provide any misleading, false or incorrect information then GI reserves the right to cancel your participation in the programme at any time and you will forfeit any fees paid.

The acceptance letter will include a placement date deadline set by you subject to our agreement.

Participants agree to cooperate fully with GI during our endeavours to provide you with an internship placement and meet any stated deadline. Failure to do so will result in GI withdrawing you from the programme and no refund of fees will be made.

Examples of non-cooperation include but are not limited to the following:

Subject to the above if GI is unable to find you a placement to meet your required deadline then we will refund the acceptance fee. Alternatively, a participant can remain on the programme following discussion with GI who will work with you to agree new deadlines and other terms as appropriate and GI will retain the acceptance fee.

If participants fail three interviews with separate host companies GI reserves the right to withdraw you from the programme and retain the acceptance fee.

The acceptance fee is due within 7 days of you receiving our acceptance letter to enter the programme. If the deposit is not received by the due date (outlined in the acceptance letter) then GI will not proceed further with the participants application and reserves the right to request you to reapply.

If, following acceptance onto the programme, you withdraw from the programme for any reason, you will not be entitled to a refund of the acceptance fee.

5. Programme Fees

Upon receiving a confirmed placement offer participants will be required to pay 50% of the remaining programme fee, which will be adjusted to reflect the acceptance fee of USD 300 already paid.

This payment is due within 10 days of receiving the offer unless otherwise agreed with participants. If participants do not pay the stated amount by the due date (or date otherwise agreed to) then GI reserves the right to withdraw the participant from the programme, cancel the placement offer and advise the host company and no refund of the deposit will be made.

The remaining 50% of the adjusted fee is due 21 days before taking up your internship placement (and as outlined in your offer letter). If participants do not pay this stated amount by the due date (or date otherwise agreed to) then GI again reserves the right to withdraw the participant from the programme, cancel the placement offer, advise the host company and no refund of the acceptance fee or the 50% of the adjusted programme fee already paid will be made.

Participants will only be allowed to commence their internship after having made full payment by the due dates stipulated and providing a copy of their insurance policy to GI.

Where participants have agreed to pay for their accommodation directly to the accommodation provider, the programme fee will be adjusted accordingly to reflect the new revised amount and participants will be required to pay the same percentage of the new amount and by the same due dates as per the above.

If GI has to cancel your confirmed placement at any time prior to you commencing your internship for reasons which are not attributable to you then we will refund any and all fees paid or if agreed to by you endeavour to find you an appropriate alternative placement.

If GI cannot find you a placement to meet the deadline agreed with you and as outlined in the acceptance letter and you do not wish to extend the deadline then we will refund all fees paid by you.

6. Withdrawals, Cancellations and Terminations

6.1.

Withdrawals

All withdrawals must be advised to GI in writing.

If you withdraw from the programme for any reason prior to receiving a placement offer, we reserve the right to retain the acceptance fee of USD 300.

If you withdraw for any reason after having received a confirmed placement then we will retain the acceptance fee and any other fees paid. We will consider refunding fees paid, but not the acceptance fee under two circumstances – serious illness or injury, or death of an immediate family member. All withdrawals must be made in writing and in seeking a consideration of a refund of fees be accompanied by supporting documentation.

If you discontinue your placement for any reason after commencing the internship, GI will not provide any refund of the acceptance fee and programme fees.

6.2.

Cancellations

For the purposes of these Terms and Conditions any withdrawal by you will be viewed as a a cancellation by you.

If for any reason we are unable to find you a placement within an agreed timeframe (as outlined in our separate agreement with you) we will refund the acceptance fee.

If for any reason we have to cancel your confirmed placement we will provide a full refund of the acceptance fee and any other fees paid.

The above two clauses are only applicable if the reasons for non-placement or cancellation are not attributable to you.

GI will not be liable or accept any responsibility for costs incurred by you relating to any withdrawal, termination or cancellation whether attributable to us or to you the Participant.

6.3.

Terminations

If you do not provide full and correct information as requested or act in a way that we deem as being uncooperative at any stage when engaging with us, we reserve the right to terminate any agreement with you and retain the acceptance fee of USD 300 and any other fees paid.

If the host company terminates their internship agreement with you because of non-performance, failure to follow reasonable requests or to adhere to policies and procedures, unacceptable including threatening and abusive behaviour or unexplained absences from work, then no refund will be given. GI will withdraw you from the programme with immediate effect.

7. Changing Dates and Extensions

If a Participant wishes to change the start date of their placement, GI will endeavour to meet this request following agreement from the host company.

Any such requests must be made in writing and 21 days prior to the original start date of the placement.

If the host company does not agree or GI is unable to change your placement date for any other reason and you are no longer able to start the programme on the original agreed date, then you will have in effect withdrawn from the programme and GI reserves the right to retain the acceptance fee and any programme fees paid.

If GI has to change the dates of your placement for any reason and you are unable to take up your placement under the revised dates then GI will refund you the acceptance fee and all program fees paid.

GI will not be liable or accept any responsibility for costs incurred by you relating to a change to the start date of your placement.

If you wish to extend your placement once you have commenced your internship you may be charged an extension fee. Any decision to extend your placement rests with the Host Company.

We reserve the right to change our suppliers and the format of Our programs as and when necessary at Our discretion and without requiring Your consent.  We will, however, endeavour to provide as similar a Program as possible at all times.

8. Changes to Host Company and Third Party Suppliers by GI

GI reserves the right to change the host company prior to the start of your placement at our discretion.

Participants are under no obligation to accept any change of host company made by GI.

If the proposed change is not accepted by the Participant, then GI will have in effect cancelled the placement and will refund the acceptance fee and any programme fees paid.

GI reserves the right to change our third party suppliers including accommodation providers as and when necessary at our sole discretion and without requiring participants consent.

9. Insurance

You are responsible for purchasing, prior to departure, comprehensive travel insurance covering you for travel, health, medical (including any pre-existing conditions), accident and personal liability insurance for the duration of your internship.

This insurance is mandatory for each participant under the GI program and you must provide GI with a copy of the policy prior to departing for your placement.  

If you do not provide GI with a copy of your insurance policy before departure and within a reasonable time, we reserve the right to cancel your placement and no refund of the deposit or fees will be made.

You must have access to a copy of the policy documents throughout your internship programme.

Participants are responsible for making any claims under your policy directly to your insurance provider.

10. Flights

Flights are not included as part of the GI internship programme fee.

You must arrange and purchase your own flight tickets to and from the country of your internship.

You should be careful to ensure you arrive in the location prior to your start date.

If you provide GI with your flight arrival details, we will arrange a pick-up service at the airport. This pick-up service is included as part of the fee you pay to GI.

GI is not responsible for any costs or damages you incur due to changes, delays or disruptions to flights or other forms of transport booked.

11. Visas

It is your responsibility to obtain a visa where one is required before your departure.

We will provide any necessary letter of acceptance/invitation in conjunction with the host company and provide general guidance on how to complete the application form(s).

However, we shall not be held responsible if your visa application is unsuccessful or you fail to obtain a visa in time to take up your placement.

If your visa application is unsuccessful you must advise us in writing within three days of receiving advice of the outcome. In such cases we reserve the right to retain the acceptance fee and make a refund of any other fees paid.

If you fail to advise us as per the above, we reserve the right to cancel your participation in our programme and no refund of the acceptance fee or other fees paid will be made.

If you fail to obtain your visa in time to take up your placement, GI will endeavour to change the start date of your internship but cannot guarantee this in all instances. If the start date cannot be changed then GI reserves the right to retain the acceptance fee and make a refund of any remaining fees paid.

GI will not be responsible or liable for any costs or damages you incur resulting from your visa application being unsuccessful or you failing to obtain a visa in time to take up the placement  

Any visa application fee required is not covered by fees paid to GI.

12. Health & Safety and Acknowledgement of Risks

Participants acknowledge and agree that you are responsible for your own safety during your internship and that GI, our in-market representatives, accommodation providers and any host company are not liable nor take any responsibility for any damages, expenses, losses, accidents or illness in relation to services provided under our programme and during your placement. This includes any actions taken against you by any third parties.

Participants further acknowledge that there are hazards and risks associated with undertaking an internship placement in a foreign country and agree that GI, our in-market representatives, accommodation providers, host companies and any third parties contracted to provide services to you under the GI program are not liable for any loss or damages you may incur including but not limited to personal or emotional injury, death, illness including disease, damage to or loss of property.

Participants are responsible for obtaining relevant information and advice from appropriate authorities regarding health and safety conditions in the location where you will undertake your internship. GI will endeavour to assist with providing such information and refer you to specialist third parties as necessary and if requested but will not be liable or be responsible for the accuracy of any information or advice provided nor for any actions you take or don’t take following receipt of such information and advice.

Participants acknowledge and agree to disclose to and provide GI with all relevant information related to any health, including mental and physical, conditions that may impact on their ability to undertake an internship placement.

GI reserves the right to request such information from all participants as part of the process in accepting you into the GI internship programme.

If you do not declare any pre-existing physical or mental health conditions when applying for acceptance into the programme, or do not declare any health conditions you become aware of following acceptance (including during the process of our finding you an internship position or while undertaking your placement) and GI becomes aware of such conditions, then GI reserves the right to withdraw you from the programme.

Any participant who requires medications understands such medications may not be available in the placement location and you are responsible for ensuring you take adequate supplies of any medication with you to cover the time of your placement.

13. Code of Conduct and Compliance with Local Laws

Participants agree to comply with all local laws of the country in which they are undertaking their internship placement.

Participants further agree that they will comply with all policies, rules and regulations of the host company.

Participants acknowledge and agree that if they break any laws of the host country or fail to comply with the policies, rules and regulations of the host company at any time during their placement, GI reserves the right to cancel your placement and withdraw you from the programme with immediate effect. No refund of any fees will be made.

Participants agree to behave in a responsible manner at all times during your placement and treat GI staff, our in-market representatives, third party suppliers and their staff and host company personnel and co-workers with respect.

Participants agree not to engage in any behaviour that could bring disrepute to GI or its in-market representatives, third parties we engage with in providing services to you and host companies. Examples of such behaviour include but are not limited to harassment, abuse, bullying, physical violence, deliberate damage to property, or unexplained absences from undertaking your placement.

Participants agree to follow any reasonable instructions given to them by GI and our in-market representatives during your placement.

Participants understand that any use of illegal drugs is strictly prohibited. If participants consume alcohol, you should ensure you drink responsibly.

Any participant who uses illegal drugs will be immediately withdrawn from the programme and your placement will be terminated.

Participants agree that they will be required to sign a Code of Conduct agreement prior to taking up their internship placement.

14. Confidentiality (including Non-Disclosure Agreements)

Participants agree to sign any non-disclosure agreement as required by the host company.

In the absence of any non-disclosure agreement participants agree not to share any information including but not limited to intellectual property, deemed confidential by the host company, with any third party. Any work you produce or contribute to during your placement remains the property of the host company.

Participants must obtain approval from the host company to use any confidential information acquired during their internship.

If Participants are undertaking a project-based placement, they agree to share the findings and any relevant material with the host company.

15. Problems and Concerns

If participants experience any problems while undertaking their placement, you agree to contact GI and or our in-market representatives in a timely manner and be available to discuss your concerns.

GI and our in-market representatives will endeavour to resolve any problems you experience, acting under the principles of good faith and transparency.

If participants are experiencing any problems or concerns regarding their host company, then you agree to inform GI or its in-market representatives and raise such issues in a professional and constructive manner with an appropriate person at the host company.

If participants have any concerns with the accommodation that has been provided (and either paid for by you directly or by GI on your behalf) then you agree to raise these with the accommodation provider and GI’s in-market representatives.

GI agrees to assist participants in meeting with accommodation providers or other parties and to work with you to address any issues, however GI assumes no responsibility for the final outcome.

GI will at its sole discretion endeavour to assist participants find alternative accommodation if necessary, but participants acknowledge that GI is not liable or obliged to do so and that GI will not be responsible for any costs incurred by you should you change accommodation.

Participants agree that neither GI, its in-market representatives or any third party accommodation provider is responsible nor assume any responsibility to resolve situations, complaints or disagreements that arise between you and any other member of shared accommodation

16. Special Requests

Participants with any special requests should notify GI in writing as early as possible. While GI will endeavour to meet any reasonable requests, participants acknowledge that we are not obligated to do so and there is no guarantee that any request will be able to be met.

Acceptance into the GI internship programme and any confirmed internship placement cannot be conditional on or subject to meeting any special request.

17. Third Parties

Participants acknowledge that GI does not represent any third party that is engaged to provide services to you under the programme and cannot be held responsible nor liable for any third party actions or behaviours.

18. Website and Promotional Material

The content displayed on our website and information contained in other promotional material as well as the pre-departure information packs is believed to be valid and correct but GI does not take responsibility and will not be held liable for any misinformation or ambiguities in the content.

19. Privacy and Data Protection

Participants should refer to GI’s Privacy Policy to obtain full details on how we collect, process and store your personal data.

20. Force Majeure

We are not liable for delays, changes or cancellations to your internship programme due to causes beyond our or a host company’s reasonable control. Force majeure events may prohibit or impede any party from performing its respective obligations through an event such as war, riots, terrorism, fire, flood, hurricane, typhoon, earthquake, lightning, explosion, strikes, lockouts, slowdowns, biological/chemical/nuclear disaster, prolonged shortage of energy supplies, and acts of state or governmental action. In these instances, no compensation or refund for any loss will be given to the participant by GI unless otherwise determined at our sole discretion.

21. Limitation on Liability

Our maximum liability to any participant in the GI programme is limited to the amount paid by you under the programme fee.

22. Indemnification

Participants agree to indemnify and hold harmless GI and its in-market representatives from any and all liability arising directly or indirectly or in connection with your participation in the program, related travel and any activities you undertake whilst in your selected host country.

23. General

GI reserves the right to change these Terms & Conditions and the services delivered under the programme at any time.

If any provision, clause or part of this Agreement be found unenforceable or invalid then all the remaining provisions, clauses and parts remain in effect and valid.

The Terms and Conditions outlined in this Agreement will be governed by the laws of New Zealand.
